The judicial commission of Inquiry into allegations of State Capture, Fraud and Corruption in the public sector including organs of State

(Zondo Commission) 2018 - January 2022

NMK Forensics has six forensic investigators and one computer forensic investigator working at the Commission. All seven investigators were vetted by the State Security Agency and were in possession of top security clearances which expired at the end of the Commission. In addition, we also have one senior forensic investigator who is not part of the team at the Commission. Who is also in possession of the top security clearance, the NMK Forensic teams at the Commission were responsible for investigating two streams which are as follows:

(1) Aviation – This involves investigating state capture allegations at SAA and its subsidiaries. (2) Defense – This involves investigating state capture allegations at Denel.

Investigations involved obtaining statements and supporting evidence from witnesses who ended up appearing before Deputy Chief Justice Zondo. The investigations were specific to certain transactions in these State Owned Organizations (SOEs) and investigations involved examining if there was any procurement fraud committed and if there is compliance with the PFMA and its Treasury Regulations.

Ethekwini Municipality Forensic Investigation Panel

2017 - 2020

NMK Forensics was appointed by eThekwini Municipality to conduct Forensic Investigations on five (5) different projects which involve the following allegations: Procurement irregularities in the awarding of orange refuse plastic bags for a period of 36 months. Procurement irregularities in the awarding of advertising contracts (billboards).

Recruitment irregularity in the appointment of the Head of Legal Services and the interference by the Head of Legal Services in the disciplinary proceedings of an employee. Procurement irregularities in the awarding of Litter Bins contract. Irregular payments made by Human Settlement related to Hostels.

Department of Social Development Forensic Investigation

2019

NMK Forensics was appointed by KZN Social Development to conduct Forensic Investigations into the allegations of the following:

Procurement Irregularities in the appointment of an NPO which delivers food parcels to the NPO/NGO’s in the province. The investigation also involves the appointment and existence of EPWP workers who are enrolled in the program.

Zululand District Municipality

October 2019 - April 2022

NMK Forensics was appointed by Zululand District Municipality to conduct Forensic Investigations on the following allegations:

Supply Chain Management Irregularities in the procurement processes regarding the appointment of various service providers. Irregular payments made to service providers.

Vryheid Municipality

September 2019 - October 2019

NMK Forensics was appointed by Abaqulusi Local Municipality to conduct Forensic Investigations on the following allegations: Supply Chain Management: Irregularities in the appointment of panels of professional services providers (legal services and Engineers). Irregularities in the utilisation of such panels > Engineers being used as evaluation committee and lack of rotation in the use of legal firms. Lack of accountability in the payments made under legal services.

Human Resources:

Non-disclosure by an executive member(s). Failure to verify the qualification of new appointees.
Development of structure(s) to accommodate specific individuals. Irregular appointments – without meeting minimum requirements. Appointments to unevaluated posts. Inflated salaries to certain employees.

Eskom Limited SOC

2016 - 2019

NMK Forensics was part of the Panel of Forensic Investigations at Eskom between 2016 and end of 2019. In this period, NMK has conducted investigations on more than 25 cases. Investigations mainly involve procurement fraud, supply chain management irregularities and Human Resource Irregularities.

Procurement Investigations mainly involved a review of the procurement process followed which culminated in the appointment of the Service Provider in question by the SOE, to establish compliance with the applicable precepts. Our investigators have appeared on various internal disciplinary cases as expert witnesses for Eskom. We have also assisted Eskom to open criminal cases with the law enforcement agencies on various cases investigated.

KZN Cooperate Governance & Traditional Affairs

March 2018 – June 2018

NMK Forensics was appointed by KZN Cogta to conduct forensic investigations into the allegations of Fraud, Corruption, Procurement Irregularities, Recruitment Irregularities, and Maladministration leveled against municipal personnel of Nongoma Local Municipality.

The investigation confirmed that there were irregularities in the procurement process followed by the municipality in awarding the contracts under question, fraud and corruption were discovered and it was also found that there were re-cruitment irregularities. Recommendations were made to the MEC for Cogta, to pursue criminal and disciplinary processes against persons identified in the forensic investigations. The final report is still to be presented to the MEC and the Municipal Council on the to be determined.

Council of Medical Schemes

June 2018 – November 2018

NMK Forensics was appointed by the Council for Medical Schemes to conduct detailed inspections into the affairs of Platinum Health Medical Scheme and South African Breweries Medical Scheme, in terms of section 44(4)(a) of the Medical Schemes Act read with the Financial Sector Regulation Act of 2017.

The investigation involves irregularities and transgression of the Medical Schemes Act. NMK Forensics conducted interviews, secured evidence, and the drafting and finalisation of the forensic report to the Registrar, along with a team of forensic investigators and accountants. The investigation has been completed and a final
the report has been issued.

Jozini Local Municipality

October 2018 - December 2018

NMK Forensics was appointed by the Jozini Local Municipality to conduct Forensic Investigations into the allegations of Maladministration.

Irregular appointment of service providers; Procurement irregularities; Alleged collusion and/ or improper conduct between the Municipal Manager and Municipal Staff and service providers; Alleged financial and regulatory irregularities and mismanagement; and Financial losses suffered by the Municipality.

Sedibeng Water

September 2017 – October 2017

NMK Forensics was appointed by Entsika Consulting to render forensic investigation services on its behalf to the Sedibeng Water. The investigation involved allegations of procurement irregularities and maladministration of the Water Board, against the CEO.

The investigation confirmed that there were irregularities in the procurement processes of Sedibeng Water and recommended charges against the CEO and Supply Chain Management personnel. The CEO and Head of Procurement resigned during the disciplinary process.

Gauteng Department of Health

July 2016 – November 2016

NMK Forensics was appointed by Entsika Consulting on its behalf to the Gauteng Department of Health. The investigation consisted of five (5) allegations of corruption and maladministration in the payment of monthly stipend payments to Community Health Workers that are paid by the Department through non-profit organizations in Johannesburg and Tshwane Districts of the Gauteng Department of Health.

Various criminal cases have been opened by the Gauteng Department of Health as a result of this investigation and NMK Forensics is currently assisting the Hawks in Gauteng in taking criminal investigation cases forward.

Mtubatuba Local Municipality

July 2016 – November 2016

NMK Forensics was appointed by the Mtubatuba Local Municipality to investigate the alleged procurement fraud for the tender that was awarded to a service provider. The investigation came as a result of a complaint lodged to the office of Municipal Manager regarding an employee who was alleged to have used his work position to influence the award of a tender by the Municipality.

The alleged influence resulted in a tender of R2 million to a company owned by his wife for the construction of a certain road within the Municipality. The investigation revealed that the tender was not awarded in terms of the MFMA and Treasury Regulations. The bidder did not declare in the tender documents that she is married to an employee of the Mtubatuba Local Municipality. A Forensic Investigations Report with findings and recommendations has been tabled to the Council and the Municipal Manager.

KZN COGTA

2016

NMK Forensics was appointed by KZN Cogta to conduct private forensic investigations into the alleged hacking of Gmail Accounts for the MEC and some Ministry Staff. The alleged hacking occurred in August 2015. In August 2015, some e-mails were sent from the Gmail account of the MEC to the ministry staff and from some ministry staff to their colleagues. These e-mails were not business-related and were sent without their knowledge. NMK Forensics then conducted Computer Forensic Investigations into the alleged hacking of the Gmail account of the MEC and some Ministry staff.

The investigation revealed that there exists a huge risk of system violations due to systems vulnerability within the department. This was inter alia coursed by staff who were not logging into the department’s systems which automatically would provide system updates including virus definitions amongst other things. The findings were that the e-mails were not hacked; however, this was as a Malware which created a Phishing e-mail that could have been managed if computer systems were adequately protected. The project was completed in March 2016.

Services SETA

June 2014 – February 2015

NMK Forensics and its consortium partners were appointed by the Services SETA to investigate the appointment and awarding of services providers through the Supply Chain Management Policy. Compliance with the Discretionary Grant Policy was to be ascertained and any irregularities reported on.

This investigation has resulted in the recommendations by NMK and its consortium partners to Services SETA for the suspension of further payments to certain Service Providers to the value exceeding R200 million.

KwaZulu-Natal (KZN) Department of Agriculture

2013 - 2014

NMK Forensics was appointed by the Department of Agriculture to conduct an investigation in procurement in alleged fraud and corruption involving the HOD, the Supply Chain Department, the Finance Department, and the Food Security Department. Recommendations were made to the Department regarding the involved officials however the investigation has been extended to implement the recommendations in terms of disciplinary hearings and criminal charges being made.

The Department is currently opening criminal cases, and the State Attorney is working together with our team on Civil Forfeiture.  Two employees were dismissed based on the findings and recommendations of our report. The total value of the investigation was more than R290 million rand.
